Meal and rest break tracking app

A meal and rest break tracking app watches every shift from the clock-in punch, reminds the employee before each break is due, records whether the break was taken on time, logs premium pay when it was not, and keeps the whole sequence as evidence. SafeShift does this with push and SMS reminders in English and Spanish, state-specific break rules per location, and a clock-out attestation where the employee confirms their breaks. It works with a PIN kiosk tablet, a geofenced mobile app, or Toast, Square, and Clover POS punches.

Break rules by state

California is the strictest and the most fully covered: a 30-minute unpaid meal period before the end of the fifth hour on shifts over five hours, a second meal period on shifts over ten hours, a paid 10-minute rest break for every four hours worked or major fraction, and one hour of premium pay per workday for each category missed. SafeShift applies the meal-period waiver rules for shifts of six hours or less, shifts rest windows forward when a meal break does not count as hours worked, and collects waiver and on-duty meal agreements with e-signatures.

Florida, Texas, Georgia, and Idaho have no state break mandate. SafeShift turns the break machinery off there rather than inventing rules, marks break reporting as not applicable so a report never shows a false gap, and applies federal overtime and the tip credit instead. Additional state rule profiles are being added through 2026. Rules are data, not code, so a new state is a new rule set.

Three ways to clock in

  • PIN kiosk: any tablet at the entrance becomes a punch clock. Employees clock in, start breaks, and clock out with a four-digit PIN; the tablet keeps working offline and syncs when it reconnects.
  • Mobile app: geofenced clock-in on the employee's own phone, with the break countdown and reminders built in.
  • POS sync: Toast, Square, and Clover punches flow in every five minutes, so nobody clocks in twice. Breaks recorded on the POS are classified as meal, rest, or working time by one normalizer; locations whose POS has no break punches use the Attestation Station at clock-out instead.

Clock-out attestations: the employee's own word

At the end of each shift the employee answers a short set of questions: did you receive your meal break, did you receive your rest breaks, was anything short. A shift that ran long or a break that ran short gets its own question. Owners can reword the questions and add their own, such as an injury declaration. Each answer is signed, timestamped, and attached to the shift. In a wage claim, a shift-by-shift record of employee confirmations is among the strongest evidence an employer can have.

What managers see

The Compliance page groups each day's exceptions so the manager only looks at what needs a decision: confirm the violation, void it with a reason, or fix the punches. Clean days are confirmed automatically. The daily digest email and the weekly summary list what was handled and what is still open, and the Time Entries report shows total, unpaid meal, paid hours, and overtime per person for payroll.

Common questions

What counts as a missed break?

A meal or rest break that did not start by the deadline the state rule sets for that shift length, judged from actual punches. Late and short breaks are also recorded. Sub-two-minute accidental punches are stored as voided artifacts so they never count as a break.

Can employees waive a meal break?

In California, the first meal period can be waived by mutual consent on shifts of six hours or less, and the second on shifts of twelve hours or less if the first was taken. SafeShift collects the waiver with an e-signature and adjusts the reminders for that shift; violations still judge what actually happened.

Do reminders go out in Spanish?

Yes. Each employee has a preferred language, and every reminder, attestation, and certification follows it. The employee app and the kiosk are bilingual.

What about a five-hour shift?

California's meal requirement applies to shifts over five hours, so a five-hour schedule owes no meal reminder. If the employee stays past the planned end, SafeShift sends a boundary warning that a meal break becomes required and the reminders revive.
