What PAGA is, and why records decide it

The Private Attorneys General Act (Labor Code §2698 and following) lets one employee sue on behalf of every current and former employee for Labor Code violations, with penalties assessed per employee per pay period plus the plaintiff's attorney fees. Meal and rest break claims are the most common theory, because a single missed break is easy to allege and hard to disprove without records.

Once a claim starts, the question is not whether a break was ever missed. It is whether you can show, shift by shift, that breaks were provided and that any miss was paid. Labor Code §226 gives an employee or their attorney the right to copies of wage records within 21 days of asking, and California requires time records to be kept for at least three years. An employer who cannot produce them has no defense.

The 2024 PAGA reform (AB 2288 and SB 92) added the other reason records matter: an employer that took all reasonable steps to comply before receiving a notice has penalties capped at 15 percent, and one that takes them within 60 days after the notice is capped at 30 percent. Written policies, training, regular audits of time records, and fixing problems when they surface are what the statute lists. SafeShift documents each of those steps as they happen.

The records a PAGA defense needs

  • Break reminders sent, with the time each one went out and the channel (SMS, push).
  • Breaks taken, late, short, or missed, from actual punches, judged against the state rule for that shift length.
  • Premium pay logged for each missed meal or rest period (Labor Code §226.7), at the regular rate, capped at one meal and one rest premium per workday.
  • Clock-out attestations: the employee confirming at the end of the shift that breaks were received, or flagging that they were not, signed and timestamped.
  • Pay-period certifications: the employee reviewing their time records each pay period and certifying them, or raising a concern.
  • Policy acknowledgments and training records, e-signed and retained.
  • An immutable audit trail: violations are never deleted, only voided with a reason, and every time-card edit keeps the before and after.

How SafeShift produces each one

Employees clock in on a PIN kiosk, the geofenced mobile app, or the POS they already use. From that punch, SafeShift schedules the break windows for the shift under the location's state rules, sends a push notification two hours before a rest break and a push plus SMS thirty minutes before any break, warns ninety seconds before a deadline, and records a violation the moment the deadline passes without a break. Managers are alerted in real time so the miss can be fixed that day.

At clock-out the employee answers the attestation questions on the kiosk, their phone, or the Attestation Station for POS-clocked teams, in English or Spanish. Each pay period they review and certify their time. All of it lands in the Compliance page as exception-only work for the manager: confirm, void with a reason, or correct the punches.

When a records request or a PAGA notice arrives, the compliance report exports the full history for any date range as a PDF with the evidence attached and a CSV for counsel. Nothing has to be reconstructed.

Common questions

Does PAGA compliance software replace an employment lawyer?

No. SafeShift produces the records and the timeline; your attorney decides how to use them. What changes is that the records exist, are complete, and can be produced in minutes instead of being reconstructed from memory and spreadsheets.

What if an employee chose to skip a break?

California requires employers to provide breaks, not to force them. SafeShift records that the reminder was sent on time, what the employee did, and the employee's own clock-out attestation about whether the break was offered. That is the evidence that distinguishes a provided-but-declined break from a denied one.

How far back do the records go?

Everything from the day a location goes live, kept for the life of the account and exportable at any time. Compliance records are never deleted; voided violations stay on file with the reason.

Does it work with my POS?

Yes. Toast, Square, and Clover sync directly, so employees keep clocking in the way they do today. Locations without a POS use the PIN kiosk or the mobile app.
